These Terms of Service ("Terms") govern your access to and use of EScout (the "Service"), operated by EScout ("EScout," "we," "us," or "our"), including the website at escouthunt.com and any installed app version. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
EScout provides interactive maps, satellite and topographic imagery, public land-ownership boundary data, terrain and habitat layers, and "Scout AI" — an automated feature that analyzes publicly available terrain and habitat data to suggest possible whitetail deer bedding areas, travel corridors, and stand locations.
Scout AI outputs, and any land ownership, boundary, or terrain data shown in the Service, are suggestions and estimates only. They are generated from third-party public data sources and are not a survey, legal record, or guarantee of accuracy, and may be outdated, incomplete, or incorrect.
You are solely responsible for verifying land ownership, obtaining permission before entering any property, and complying with all applicable hunting laws, seasons, licensing requirements, and regulations in your jurisdiction. EScout does not grant, and cannot grant, permission to access or hunt on any land. Never rely on boundary lines or ownership data shown in the Service as a substitute for a legal survey, permission from a landowner, or verification with the relevant public land management agency.
You assume all risk associated with outdoor activity, including hunting, based on information from the Service. EScout is not liable for trespass, citations, injury, property damage, or any other consequence arising from your use of map, boundary, or Scout AI data.
EScout does not require a traditional username/password account. Instead, your browser or device is assigned an anonymous visitor identifier used to sync your subscription status, waypoints, and saved data. You are responsible for keeping access to the device or browser where that identifier is stored, since we have no way to otherwise verify your identity or recover it if lost.
See our Refund Policy for details on refunds.
You agree not to: use the Service for any unlawful purpose; attempt to interfere with, disrupt, or gain unauthorized access to the Service or its infrastructure; scrape, resell, or redistribute EScout's map or boundary data as a standalone product; or misrepresent your identity or subscription status (including by circumventing paywall or redemption-code controls).
Waypoints, notes, and other data you create in the Service ("Your Content") remain yours. You grant EScout a limited license to store and process Your Content solely to operate the Service (e.g., syncing it back to your device). We do not sell Your Content.
EScout relies on third-party data providers (including public GIS/land records and satellite imagery sources) and infrastructure providers. We do not guarantee uninterrupted availability, and imagery, boundary, or terrain data may be delayed, cached, or occasionally unavailable.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY OF MAP, BOUNDARY, TERRAIN, OR SCOUT AI DATA.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESCOUT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE. ESCOUT'S TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID ESCOUT IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
We may suspend or terminate access to the Service for violation of these Terms. You may stop using the Service and cancel your subscription at any time.
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Mississippi, USA, without regard to conflict-of-laws principles.
